1. General

ARDEJE (whose head office is located at 80 rue Henri Poincaré - 26500 Bourg-lès-Valence), in its capacity as data controller, attaches great importance to the protection and respect of your private life. This policy is intended to inform you of our practices regarding the collection, use and sharing of information that you may provide to us through our platform (the "Platform") accessible from the website www.ardeje.fr or our mobile applications. ARDEJE will subsequently be referred to as "ARDEJE", "we" or "us".

This policy (together with any documents referred to in it and our cookie policy) sets out how we handle the personal data that we collect and that you provide to us. We invite you to read this document carefully in order to know and understand our practices regarding the processing of your personal data by us.

2. The information we collect

We may collect and process the following data :

2.1. Information you provide directly to us

By using our platforms, you are required to send us information, some of which may identify you ("personal data"). This is particularly the case when you fill in forms, when you contact us - whether by telephone, email or any other means of communication - or when you report a problem to us.

This information includes the following data :

Data necessary for the implementation, application and execution of the purchase contract or for access to any other service provided by us. This data includes your first and last name, e-mail address, postal address, gender, telephone number and password. This information is mandatory. Otherwise, ARDEJE will not be able to provide you with the services offered by our platforms and you will not be allowed to create an account on our platform.

2.2. The data we collect automatically

During each of your visits, we may collect, in accordance with applicable law and with your consent, where applicable, information relating to the devices on which you use our services or the networks from which you access our services, such as, in particular, your IP addresses, connection data, types and versions of Internet browsers used, types and versions of browser plugins, operating systems and platforms, data concerning your browsing on our platforms, in particular your browsing on the various URL pages of our platforms, the content you access or consult, the search terms used, the download errors, the duration of consultation of certain pages. One of the technologies we use to collect this information is the use of cookies (for more information on cookies, please refer to our Cookie Policy).

2.3. How long we keep your data

2.3.1. With the exception of the categories of personal data referred to in articles 2.3.2. and 2.3.3. below, your personal data is archived after the following periods :

  • 5 years after your last use of our platforms, if you have not closed your account;
  • 1 year after you close your account.


2.3.2. The following categories of personal data may be retained for different periods of time :

  • Financial data (payments, reimbursements, etc.) are kept for the period required by the applicable tax and accounting laws;
  • Content created by you on our platforms (such as comments, reviews and ratings) will be anonymised after the time periods mentioned in 2.3.1 but will remain visible on our platforms.

2.3.3. In the event that your account has been suspended or blocked, we will retain your data for a period of between 2 and 10 years from the date of suspension in order to avoid any bypassing by you of the rules in force on our platforms.

3. How we use the data we collect

1. To manage your registration as a user of the platform The processing of your data is necessary for the execution of the conditions governing the use of the platform. In other words, the processing of your personal data is necessary to register you as a user of the platform.
2. For the implementation, application and execution of the purchase or service contract concluded with us in the platform The processing of your personal data is necessary for the performance of the purchase or service contract with which we are bound.
3. To respond to requests or queries made through the Customer Service channels We consider that we have a legitimate interest in responding to queries or requests that you make to us through the various existing means of contact. We believe that the processing of this data is also in your interest as it allows us to properly handle your requests and answer your questions. When you contact us, in particular for the management of incidents concerning your order or the product / service purchased on the platform, the processing is necessary for the execution of the purchase contract. When your question concerns the exercise of the rights we inform you about below, or complaints about our products or services, the processing of your data is based on compliance with our legal obligations.
4. For marketing purposes The legitimate basis for processing your data for marketing purposes is the consent you give us, for example by agreeing to receive personalised information through various means, or when you agree to the legal conditions to participate in a promotional action or to post your photos on the platform or our social media channels.
5. Ergonomics and quality analysis to improve our services We consider that we have a legitimate interest in analysing the ergonomics of the platform and the degree of user satisfaction since we believe that the processing of this data is also in your interest since its purpose is to improve the user experience and offer a better quality service.

4. Who are the recipients of the information we collect and why do we give them this information ?

4.1. In the course of using our services, some of your information is passed on to our distributors and resellers as part of the process of ordering products, requesting quotes, delivering our products and registering products.

4.2. We may also share information about you, including personal data, with other entities of the ARDEJE group in accordance with this policy.

4.3. We also work closely with third party companies who may have access to your personal data, including :

  • the subcontractors we use for payment services, delivery services (e.g. DPD), identity verification or providers of analytical solutions.

4.4. We only share your data with the third parties mentioned in 4.3. above in the following cases :

  • 4.4.1. Where we use a service provider in connection with the performance of any contract entered into between you and us or in order to provide or improve our services (for example, in connection with payments made via our platforms, or delivery) ;
  • 4.4.2. When we use search engine and analytics providers to improve and optimize our platforms ;
  • 4.4.3. When we are legally required to do so or if we believe in good faith that it is necessary to (I) respond to any claim against ARDEJE, (II) comply with any judicial request, (III) enforce any contract entered into with our members such as the Terms of Use and this Privacy Policy, (IV) in case of an emergency involving public health or the physical integrity of a person, (V) in the context of enquiries and investigations, or (VI) in order to guarantee the rights, property and safety of ARDEJE, its members and more generally any third party ;
  • 4.4.4. In the event that we sell or acquire a business or assets, in which case we reserve the right to share your personal data with the prospective seller or buyer of that business or assets.
  • 4.4.5. If ARDEJE or all or part of its assets are acquired by a third party, the data in our possession will, if necessary, be transferred to the new owner.

5. Targeted advertising, emails and SMS messages we send you ?

In accordance with applicable law and with your consent where required, we may use the data you provide on our platforms for marketing purposes (for example to (I) send you our newsletters, (II) send you invitations to our events or other communications that may be of interest to you and (III) display targeted advertisements on social media platforms or third party sites).

With respect to promotional emails : You may withdraw your consent at any time by (I) unchecking the relevant box in your account, (II) clicking on the unsubscribe link provided in each of our communications or (III) contacting us as described in section 12 below.

With regard to targeted advertising :

  • On social networking platforms (e.g. Facebook, Twitter) : you can object to this processing at any time by configuring the advertising settings in your account ;
  • On third party sites : you can refer to our Cookies Policy to understand how to withdraw your consent.

6. Is your data transferred, how and where ?

As a general rule, we keep your personal within the European Union. However, to the extent that, for example, some of our service distributors are located in countries outside the European Union ("Third Countries"), we transfer some of your personal data to Third Countries. This may in particular be the case towards Third Countries for which the European Commission has not taken an "adequate protection" decision. In such a case, we ensure that the transfer is carried out in accordance with the applicable regulations and guarantees a sufficient level of protection of the privacy and fundamental rights of individuals (in particular through the European Commission's standard contractual clauses).

7. What are your rights to your personal data ?

7.1. You have the right to receive a copy of your personal data in our possession ("right of access").

7.2. You may also request the deletion of your personal data and the rectification of incorrect or obsolete personal data ("right of deletion and right of rectification"). Please note that we may retain certain information about you where we are required to do so by law or where we have a legitimate reason to do so. For example, if we believe that you have committed fraud or breached our Terms of Use and we wish to prevent you from circumventing the rules applicable to our community.

7.3. You also have the right to object at any time, on grounds relating to your particular situation, to (I) the processing of your personal data for direct marketing purposes or to processing carried out on the basis of our legitimate interest ("right to object").

7.4. You have the right to limit the processing of your personal data ("right to restriction"). Please note that this right only applies if (I) you challenge the accuracy of your personal data during the period in which we can verify its accuracy; (II) in the event of unlawful processing by us and you request a restriction of their use rather than their deletion, (III) we no longer need the personal data for the purpose of processing, but they are still necessary for the establishment, exercise or defence of legal claims; (IV) if you exercise your right of objection during the period of verification as to whether the legitimate reasons we are pursuing override yours.

7.5. You have the right to lodge a complaint with the competent supervisory authority or to obtain redress from the competent courts if you consider that we have not respected your rights.

7.6. You also have the right to the portability of your data, i.e. the right to receive the personal data you have provided to us in a structured, commonly used and machine-readable format and the right to transmit this data to another data controller ("portability right").

7.7. You also have the right to specify what happens to your personal data after your death.

9. Confidentiality of your password

You are responsible for maintaining the confidentiality of the password that we have chosen for you to access your account on our platforms.

Please note that these websites have their own privacy policies and that we are not responsible for the use made by these websites of the information collected when you click on these links. We may change this privacy policy from time to time. When necessary, we will notify you and/or seek your consent. You should check this page regularly for any changes or updates to our privacy policy.
